Avoid Conflicts of Interest
Unless otherwise directed, you may only use PixMD as a consumer.
Do not use PixMD to promote your own interests or those of anyone you know which are unrelated to the stated purpose of PixMD or mutual benefit of the PixMD community.. This includes both: In short, do not post if the purpose of your post could be reasonably understood to be to create a benefit or gain anything of value to you or someone you know, rather than for the general benefit the PixMD community. In addition to the Code of Conduct above, these additional guidelines apply to Health Care Providers on PixMD: Health Care Providers are expected to maintain professionalism at all times on PixMD. Do not bully or post disparaging comments about community members, other Health Care Providers, or PixMD. Do not post any content that violates HIPAA or other applicable health-privacy laws. Consider the privacy and safety of all community members before posting. All uploaded photos and videos must adhere to these Guidelines. Clearly explain any conflicts of interest, including products, brands and research funded by third parties from which you are receiving a benefit or anything of value. For example, if you are receiving money from a brand whose product you endorse, you are required to clearly and unequivocally define this relationship in all relevant posts. You may not solicit or receive reviews from anyone with a personal or professional bias. This includes past and present employees, colleagues and family members. You also may not use third-party services to collect and post reviews on behalf of community members. Ask your doctor advisor about using Patient Engage to help you obtain reviews from consumers who have received a treatment or procedure from your practice. The mission of PixMD is to help consumers make confident decisions about elective cosmetic procedures. False reviews, “helpful vote” abuse and other dishonest practices erode trust and will not be tolerated. Health Care Providers who violate PixMD’s Terms of Service, Health Care Provider Code of Conduct, the Code of Conduct or the Photo & Video Guidelines may have their profiles suspended, limited or removed, temporarily or permanently, in PixMD’s sole and absolute discretion. An audit will be initiated in the event that one or more geographically non-competitive peer negatively reports a Health Care Provider's posts or behavior on PixMD. PixMD may also conduct periodic audits of a Health Care Provider’s profile in order to ensure compliance. It is your responsibility to abide by all laws, including consumer protection regulations and privacy laws. In this regard, you agree to defend, indemnify and hold harmless PixMD and its affiliates, directors, officers, contractors, employees and agents from and against any and all claims, injury, damages, losses, liabilities, costs and expenses of defense (including but not limited to, reasonable legal fees and or attorneys’ fees) incurred directly or indirectly with your use of the Site/Services. In the event of such a claim, we may, in our sole and absolute discretion, control the disposition of any such claim at your sole cost and expense. You may not settle any such claim without our express written consent. In the event that PixMD determines to actively defend in a dispute, you agree to fully cooperate with PixMD in asserting any available defenses, and providing any documents, information, testimony or similar evidence from your representatives. In no event will PixMD or its affiliates, directors, officers, contractors, employees and agents be liable to any user of our Site/Services or any other person or entity for any direct, indirect, special, incidental, consequential, or exemplary damages or punitive damages arising out of the use, performance, or inability to use the Site/Services, unauthorized access to or misuse of the Site/Services or any information contained thereon, whether based upon warranty, contract, tort, strict liability, violation of statute, rule or regulation, or otherwise, even if PixMD had been advised of the possibility of such damages or losses. Because some states or jurisdictions may not allow the exclusion or limitation of liability for certain damages, in such states or jurisdictions, our liability shall be limited to the maximum extent permitted by law. Dispute a Review on PixMD? We only remove reviews that violate our Terms of Service. We do not remove otherwise reviews at the request of users. If you want a certain review removed because you believe it violates our Terms, please submit your dispute in writing, indicating which term or terms you believe have been violated, via our online dispute form. These Codes of Conduct, along with Guidelines posted on or through the Site or Services, our Terms of Service, and any other terms, conditions and policies we post or update from time to time constitutes our entire agreement with you on the subjects contained within.
